Mbank lifestyle club is an exclusive online marketplace with offers and deals to Al Maryah Community Bank LLC customers for banking activities carried out related to bank products and services at Al Maryah Community Bank LLC.

GENERAL REQUIREMENTS

  1. This program does not change the provisions of other banking activities in Al Maryah Community Bank LLC
  2. Customers remain subject to and comply with the terms and conditions relating to banking activities determined by Al Maryah Community Bank LLC, including applicable laws and regulations
  3. Al Maryah Community Bank LLC can make changes at any time related to the terms and conditions, which Al Maryah Community Bank LLC will then inform all Customers in the form and manner determined by Al Maryah Community Bank LLC
  4. Decisions, provisions, and amendments to the provisions made by Al Maryah Community Bank LLC cannot be contested.

Mbank lifestyle Club, can be accessed through the digital banking app:

  1. Mbank UAE, through this app, transactions can be made for all goods/services categories.
  2. In the online purchases/bookings process, Al Maryah Community Bank LLC will be assisted by partners (third parties) who have collaborated with Al Maryah Community Bank LLC. The partner will be responsible for providing up to the delivery.
  3. Every customer will receive a One Time Password (OTP) to the mobile number recorded in the Al Maryah Community Bank LLC system for any payment transaction. If the customer does not have a valid mobile number in the Al Maryah Community Bank LLC system, the customer is asked to update the data at the nearest Al Maryah Community Bank LLC Branch Office.
  4. For every payment transaction, the customer will receive an SMS / e-mail notification that will be sent via the mobile number or e-mail address indicated on the Al Maryah Community Bank LLC system.
  5. Payment transactions cannot be canceled unless Al Maryah Community Bank LLC and or Al Maryah Community Bank LLC partners cannot fulfill the delivery of the selected goods/services. In this condition, Al Maryah Community Bank LLC will return the payment that has been made.

CATEGORY OF Offers and Deals

  1. Travel, special categories related to travel such as airplane tickets, hotels, car rentals, and others.
  2. Non-travel, categories in the form of goods/services such as electronic devices, fee waivers, subscription services, and others.
  3. Vouchers, in physical or electronic form such as shopping vouchers, hotels, pulses, and others.
  4. Categories and types of offers and deals may change at any time depending on the availability of goods/services. Al Maryah Community Bank LLC has the right to change the list of categories and types of offers and deals without prior notice.

PARTICIPATION IN Mbank lifestyle club

  1. Customers are asked to register on the Mobile App Program Name to participate in this program.
  2. All Al Maryah Community Bank LLC products and services owned by customers will be automatically registered to Mbank lifestyle club.
  3. If goods and/or services that are owned by customers do not match the data on Mbank lifestyle club, the customer is required to confirm or update the data to the Al Maryah Community Bank LLC Branch Office.
  4. To get Mbank lifestyle club, customers must follow the conditions in getting offers and deals.
  5. Program participation will automatically end if the customer no longer has an account at Al Maryah Community Bank LLC and/or the customer dies and/or the customer is declared not entitled to offers and deals by Al Maryah Community Bank LLC for committing fraud in collecting Mbank lifestyle club or violating other banking regulations. In this case, Al Maryah Community Bank LLC is fully entitled to cancel the customer's participation in this program.

FAILURE OR BREACH

  1. Al Maryah Community Bank LLC has the right to refuse, cancel the Mbank lifestyle club or temporarily block the Mbank lifestyle club account of customers who commit violations/omissions such as customer Mbank lifestyle club indicated obtained from unnatural transactions.
  2. Every refusal, cancellation of offers and deals or blocking Mbank lifestyle club accounts will be notified by Al Maryah Community Bank LLC to customers in the form and manner determined by Al Maryah Community Bank LLC
  3. If the customer is legally and convincingly proven that the Mbank lifestyle club offers and deals of the Customer were obtained from an incorrect/improper transaction. Then Al Maryah Community Bank LLC has the right to declare the Customer has committed negligence/violation and Al Maryah Community Bank LLC has the right to terminate the participation of the customer in the Mbank lifestyle club.

  1. These terms and conditions are an inseparable unity with the provisions and information submitted by Al Maryah Community Bank LLC Name including through other media such as letters, posters, flyers, and others.
  2. Offers and Deals that have been selected cannot be returned or exchanged for cash or other Offers and Delas.
  3. Customers are required to maintain the confidentiality and security of customers Al Maryah Community Bank LLC accounts including electronic devices and communications used by customers to access Al Maryah Community Bank LLC accounts.
  4. Al Maryah Community Bank LLC has the right to carry out maintenance activities and or changes in technical specifications and access to Mbank lifestyle club
  5. All losses and/or claims arising as a result of negligence and/or negligence of the Customer in maintaining the security of Mbank lifestyle club account passwords and supporting devices used by the Customer to access Mbank lifestyle club accounts so that they can be used by irresponsible parties and cause financial losses are the customer's responsibility.
  6. Product and/or transaction terms and conditions and/or others not regulated in these terms and conditions will follow the terms and conditions that apply to each product/transaction.
  7. The Mbank lifestyle club Al Maryah Community Bank LLC is in collaboration with Giift Management DMCC (Giift).

ONLINE OFFERS

Definitions

  1. This is a legal document that dictates all the terms and conditions for the use of the online offers and redemption option on the Al Maryah Community Bank LLC (“Al Maryah”) rewards platform on mobile application. Please read these terms of service ("Terms of Service" or "Agreement") carefully as they contain the legal terms and conditions that you agree to when you register and use the service provided by us. The terms and conditions may be subject to change in the future as per updates from Merchants/Stores/Retailers end on e-commerce websites where you are transacting, and they deliver the products/services to you.

Our Service Introduction

  1. Online offers enable registered users to be able to get savings in the form of Al Maryah Rewards for transactions that are completed on their mobile apps where tracking is enabled. The prices are the ones that we obtain using our automated software 'crawlers/scrapers’ from the e-commerce websites or via the price/product feeds sent by the e-commerce websites directly or through affiliate ad networks. While it is our best effort to keep the prices listed on our App up to date, however, the e-commerce websites may change their prices more often than we can update our prices, and thus there can sometimes be a difference in prices listed on our App and the e-commerce website as well as differences in the prices on their websites and their mobile apps, however, you will always be able to see the most updated price on the e-commerce websites once you are redirected there.

Customer Journey

  1. To receive the benefits of the cashback offers at online offers, Al Maryah cardholders will need to: (i) log in to the Al Maryah rewards platform through the app and opt for the online offers redemption option; (ii) browse the items from the listed Retailers; (iii) click on the relevant Retailer’s link; (iv) continue to retailer’s webpage to finalize the purchase: ensuring that they do not close the session. This is so that the cashback program can track purchases on the retailers’ webpage. Al Maryah cardholders visiting the retailer’s website directly and/or visiting the website via the online offers option on the Al Maryah rewards website but closing and restarting a new session will not be eligible to earn cashback.

Cashback Offers

  1. When you complete a valid transaction at one of our partner e-commerce websites within Al Maryah App and once we receive the approval from the merchant for such valid and tracked transactions, then part of this will be passed to you as cashback as per the cashback amount that was communicated on our app within 45-75 Days ( Timespan may vary basis return/ exchange period for a product on merchant website and subjected to individual merchant policies.
  2. Please note, the cashback amount will be credited to your Primary Account only.
  3. A valid transaction is defined as one where a registered user was logged in and clicked out and completed a transaction on one of our partner websites within Al Maryah App. Please note that whether or not a transaction shall qualify as a valid transaction for cashback, is completely at the discretion of the merchants or Al Maryah’s third-party vendors, and customers have to understand and agree to the same.
  4. Al Maryah Bank cannot be held responsible if the stores or the stores' network fail to report a sale to us or does not qualify a transaction as a valid transaction for cashback. Also, Al Maryah cannot be held responsible in the event due to some technical, network, or other error we cannot trace a sale back to our customer and do not qualify the transaction as a valid transaction for cashback for any reason whatsoever

Missing Reward Enquiries and Requests

  1. If your Al Maryah cashback has not been tracked in pending status within 72 hours from the transaction time or has been tracked at a lower amount then you may be able to raise a missing Al Maryah Reward request but only up to 10 days from the date of your transaction, following the expiry of the return or cancellation period on the website, as merchants will not answer any queries about tracking rewards/cashback in pending status after 10 days of transacting.
  2. While we will make our best efforts in following up with the merchants to track your rewards/cashback, however, the decision of the merchants/stores is final and binding. We also reserve the right to close any missing rewards if so, required especially when no purchase has been made or purchase has been canceled. We shall not be liable for any rejected cashback claims or where the amount tracked is lower than expected.
  3. The process for tracking missing rewards requests is that our system will only allow the customer to enter a request for the stores where a clickout id was generated when the customer clicked out from our app to that store. We save all such clickout ids in our database to be able to cross-reference rewards/cashback amounts and such queries, thus if the customer did not click out from our app, then they would not be able to raise a missing cashback request for such transactions.
  4. Also, most stores will not allow us to raise queries about transactions where the cashback payout has been declined by them or where the amount is different from what the customer expected. We will try our best to raise such queries with the stores but cannot be held responsible if the stores do not support such queries.
  5. If the stores do not respond to a particular query for more than 3 months, then we may reserve the right to close such tickets. We may be required to make balance adjustments sometimes for reward amounts and reserve the right to be able to do so when we may have given the credit error or otherwise (whether when the reward was not genuinely due or when we do not receive the payment from the store or their network/agency for misuse/fraud or other reasons).

Online Offers Role

  1. Al Maryah redemption option through online offers is only an aggregator for items/product offerings. Al Maryah offers and rewards to consumers are given out of the commission that is shared by retailers/merchants/stores for completed and valid transactions and we are not involved in selling/supplying the actual goods or services and are thus free from any liability, warranty or legal obligations that may apply to the sellers of those goods and services.
  2. Thus please note that we are not responsible for any of the below: - The quality, merchantability, safety, or legality of goods and services supplied by partner websites/stores/merchants/retailers- Whether or not the retailers deliver the goods or services to customers as we will only get information from the stores- If price changes happen often on the retailers' websites and are not updated on our website - If the retailers refuse to give the commission for transactions completed by customers as per reasons described above- If stores/banks gave an offer directly or through the affiliate networks which are invalid before their expiry, you, our customers must exercise caution while transacting online with retailers/stores. You will release us and our agents from all claims or liability arising out of any of the above issues.

Disclaimer of Warranty

  1. End-user expressly agrees that the use of app site and the microsites are at the end user's sole risk. Neither Al Maryah, its affiliates nor any of their respective employees, agents, merchants, third-party content providers or licensors, or any of their officers, directors, employees, or agents, warrant that use of the app or any microsite will be uninterrupted or error-free; nor do they make any warranty as to (i) the results that may be obtained from the use of this site, or any microsite, or (ii) the accuracy, reliability or content of any information, service or vouchers provided through this site or the microsites.
  2. This site and the microsites are made accessible on an "as is" and "as available" basis. Al Maryah hereby disclaims all representations, warranties, and conditions, whether express or implied, including, but not limited to, those of title non-infringement, merchantability, and fitness for a particular purpose.
  3. The Merchant, not Al Maryah, is the maker, and in most cases, the fulfiller, of the Product and is solely responsible for the Product and its performance.

Privacy

  1. End-User acknowledges that all discussions for ratings, comments, bulletin board service, chat rooms, and/or other message or communication facilities (collectively "Communities") are public and not private communications, and that, therefore, others may read end user's communications without the end user's knowledge. AL Maryah Bank does not control or endorse the content, messages, or information found in any Community, and, therefore, Al Maryah specifically disclaims any liability concerning the Communities and any actions resulting from end users' participation in any Community, including any objectionable content. Generally, any communication that the end-users post (whether in chat rooms, discussion groups, message boards, or otherwise) is non-confidential. If Al Maryah mobile app permit the submission of communications that will be treated as confidential, that fact will be stated on those pages. By posting comments, messages, or other information on the site or any microsite, the end-user grants Al Maryah the right to use such comments, messages, or information for promotions, advertising, market research, or any other lawful purpose without territorial, time or other limitation.

Miscellaneous

  1. Al Maryah, at its absolute discretion, shall have the right to suspend or terminate any Al Maryah cardholder access to the app or account, or any related parts. If the relevant Al Maryah cardholder or account appears to be in breach of any provision of this Agreement, or if it is believed that it is essential to protect the interests of Al Maryah Bank, it reserves the right, at its absolute discretion to amend and/or supplement these Terms and Conditions at any time without any prior notification to the Al Maryah cardholder.
  2. Any such amendments or supplements shall be provided on the Al Maryah rewards app. Under no event shall Al Maryah, any of its affiliates, or any of its officers, directors, employees, or agents be liable or responsible for any loss, damage, or expense arising out of, or otherwise related to, these Terms and Conditions, or cashback program.
  3. Al Maryah does not offer or provide any warranties or accept any responsibility or liability of any kind in respect to these Terms and Conditions, cashback program, and hereby disclaims any and all express or implied warranties concerning the same. Al Maryah shall not be in breach of its obligations or otherwise be liable to conduct this offer as a result of any Force Majeure Event. A Force Majeure Event in these Terms and Conditions shall mean circumstances beyond the reasonable control of Al Maryah including, amongst other things, acts of God, industrial disputes, acts and regulations of any government or authority in any jurisdiction. In such circumstances, Al Maryah’s obligations, if any, to the Al Maryah cardholder, shall automatically stand discharged without the need to provide notice.
  4. These Terms and Conditions are, in addition to the respective standard Al Maryah Products, terms and conditions. In the event of any inconsistency on Debit/Credit card terms, the terms of the original Debit/Credit card terms and conditions shall prevail. Al Maryah’s decision on all matters relating to the rewards app or cashback program shall, in the event of any dispute, be final and binding on all Al Maryah cardholders. These Terms and Conditions are governed by and construed in accordance with the laws of and the exclusive jurisdiction of the courts of the Emirate of Abu Dhabi.

Delivery, Return & Cancellation

  1. For any queries related to delivery / refund/ Exchange / cancellation of orders, customer needs to contact the respective merchant from whom the product was purchased. Al Maryah Bank shall not be liable in any circumstance as regards to the same.
